Air China Account Registration Service Agreement

I. General Provisions
This agreement is a service agreement entered into between Air China Limited (hereinafter referred to as "Air China") and the Air China E-ticket users (hereinafter referred to as "you"). Air China offers you various services through the Air China E-ticket Website (including the Air China Official Website [www.airchina.com] and its mobile client software, applications, etc., hereinafter referred to as "this Website"). The services provided by this Website will be strictly executed in accordance with the service terms and operating rules it publishes. After you confirm all the service terms of this Air China Account Registration Service Agreement (hereinafter referred to as "this agreement") and complete the registration procedure, this agreement is established and takes legal effect between you and Air China, and you become an official user of Air China.
You confirm that you have fully read and understood all the content of this agreement before registering an Air China account. Once you successfully register and use this service, it indicates that you agree to comply with all the provisions of this agreement. If you do not agree with any content of this agreement or cannot correctly understand the terms of this agreement, please do not check the "I Agree" box to proceed with subsequent operations. Meanwhile, you promise to comply with Chinese laws, regulations, rules, and other government normative documents. If any legal consequences arise from violations, you will independently bear all corresponding legal responsibilities in your own name. You should fully understand the terms of this agreement, especially the exemption and limitation of liability, intellectual property, and applicable law and dispute resolution clauses. Important content such as exemption or limitation of liability clauses will be highlighted in bold for your attention, and you should read them carefully.
You agree that, based on changes in national laws and regulations and the needs of this Website's operation, Air China has the right to amend the content of this agreement and related rules from time to time without separately notifying you. The changes will be announced on the Air China Official Website (www.airchina.com). If you continue to use this service after the announcement of changes to this agreement, it indicates that you have thoroughly read, understood, and accepted the amended content of this agreement and will adhere to the revised terms to use this service. If you do not agree with the amended content of the agreement, you should cease using this service.
II. Account Registration
ou acknowledge and promise that before you start registering to use the products/services of the Air China platforms, you should have full capacity for enjoying civil-law rights and performing civil juristic acts as stipulated by the Laws of the People's Republic of China, or if you do not have full capacity for enjoying civil-law rights and performing civil juristic acts, you have obtained the consent of your parents and other legal guardians and are registered and using the services of Air China under their agency. If you do not possess the aforementioned full capacity for performing civil juristic acts and proceed with account registration, you and your parents or other legal guardians shall bear all consequences resulting from this in accordance with the law.
You should, by acting in honesty, credibility, and lawful good faith, submit relevant registration information to Air China. The relevant registration information should comply with laws and regulations, the socialist system, national interests, citizens' legitimate rights and interests, public order and good customs, and information authenticity. You should not submit any illegal or harmful information, and if there are any changes to the relevant information, you should update it in a timely manner. If the registration information you provide is illegal, untrue, inaccurate, or not updated promptly, resulting in related legal responsibilities or adverse consequences, you will bear the corresponding legal responsibilities and adverse consequences.
You are aware that during the Air China account registration process, due to security and internal management reasons, some initial registration information may not be changeable. Therefore, you should meticulously verify this part of the registration information to ensure it is accurately filled out.
Upon completing the New User Registration Form, you will be able to access all the search and ticketing functions on the website. Air China will verify and protect the registration information you submit and reserves the right to cancel false registrations and those that do not comply with the rules of this Website. We will keep user registration information confidential and will not disclose it to any unaffiliated third parties. The registration information you submit that involves personal identification, such as name, ID number, and contact information, will only be used by Air China for ticket purchases, membership services, mileage redemption, and other scenarios, and will be collected, processed, and used strictly in accordance with the Air China Privacy Policy.
Except for special circumstances recognized by Air China, such as historical reasons and business integration, Air China generally only allows you to use one Air China account.If there is evidence proving or Air China has reason to believe that you have improperly registered or improperly used multiple Air China accounts, Air China may merge the relevant account information or take other reasonable measures. Should your improper registration or misuse cause losses to Air China and related parties, you shall also bear the corresponding compensation liability. In addition, for related business needs, Air China may also merge multiple accounts or related information of the same user. If such a merger will have a substantial impact on your rights, Air China will obtain your consent in advance before proceeding with the merger.
III. Account Use and Management
You can log in to the Air China platforms using the account password you registered with and that has passed the system review. To ensure the security of the relevant account, without Air China's written consent, you should not transfer or authorize others to use your account in any form, nor should you use another person's account to use this service. You must not transfer, rent, gift, or inherit the account to or from any third party.Otherwise, you shall bear all responsibilities arising therefrom. The Air China platforms reserve the right to refuse to provide corresponding services, freeze or reclaim the registered account, or terminate this agreement, and may require you to compensate for any losses suffered by Air China. If you decide to stop using the account, you should export or delete the data within the account and apply to freeze or deactivate the account according to Air China's prescribed procedures.
You are obligated to properly safeguard your account and password. After using Air China's services, you should securely log out. Additionally, you should not easily trust online information involving loans, password requests, or other financial matters. You acknowledge and agree that if any negligence in the safekeeping of your account information or the network security maintenance of related internet devices leads to account loss or leakage, you are responsible for any resulting consequences, and Air China bears no responsibility. Should Air China incur any related expenses, Air China reserves the right to seek compensation from you.
If you discover unauthorized use of your account or any other security issues, please immediately contact Air China for investigation and resolution, and modify and properly safeguard your account password. Otherwise, Air China will not be responsible for any potential losses or their escalation. Air China is not responsible for any illegal use of the account caused by hacker activities or the users' negligence in safekeeping.
You acknowledge and agree that, in compliance with laws and regulations or upon request by state authorities, Air China reserves the right to restrict or freeze your registered account. In such instances, you may be unable to continue logging in or using your registered account.
IV. User Rights and Obligations
You acknowledge and commit that during the use of the services provided by Air China, you shall comply with relevant laws and regulations, and shall not engage in behaviors that violate laws and regulations, disrupt the normal provision of services, or harm the legitimate interests of others.
(1) When transmitting technical data from within China to outside the country, it must adhere to the relevant laws of China;
(2) Do not transmit or publish: statements inciting resistance to or destruction of the implementation of the Constitution, laws, and administrative regulations; statements inciting the subversion of national sovereignty and the overthrow of the socialist system; statements inciting the division of the country and the destruction of national unity; and statements inciting ethnic hatred, ethnic discrimination, and the destruction of ethnic unity;
(3) Do not transmit or publish any information or materials that are illegal, criminal, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or uncivilized;
(4) Do not transmit or publish information or statements that violate public order and good morals or involve national security;
(5) Do not disseminate or spread activities that disrupt social stability, are reactionary and pornographic, or otherwise violate national laws and regulations;
(6) Do not interfere with the normal operation of this Website, and do not intrude into this Website and the national computer information system;
(7) Do not publish any content that is suspected of being illegal or infringing on others' copyrights, trademark rights, or other intellectual property rights, privacy rights, reputation rights, or other legal rights;
(8) Comply with all network protocols, regulations, programs, and practices for using network services;
(9) Do not use network services for illegal purposes;
(10) Without prior written permission from Air China, do not independently or authorize and assist any third party to illegally scrape any content displayed by Air China ("illegal scraping" refers to the act of obtaining content and data using programs or technical means not recognized by Air China or through abnormal browsing);
(11) Do not involve Air China in political and public events due to your use of Air China's related services.
If you engage in one or more of the above behaviors while using Air China's services, you will need to bear legal responsibility for your statements and actions. Forms of bearing legal responsibility include but are not limited to: compensating the aggrieved party, and if Air China initially bears the administrative penalties or liability for infringement damages caused by your actions (including litigation fees, attorney fees, and other related legal procedure costs), you should immediately reimburse Air China in an equivalent amount. Furthermore, depending on the specific illegal or non-compliant circumstances, Air China reserves the right to make independent judgments and immediately suspend or terminate part or all of the services provided to you, including measures such as freezing, deactivating, suspending, or closing user account services.
Under the premise of complying with this agreement, users can enjoy real-time seat availability, flight schedules, ticket prices, inquiry services, and ticket purchasing services provided by this Website. If you do not wish to receive information from this Website, you have the right to request this Website to stop sending you product and service information.
V. Intellectual Property Rights
You understand and acknowledge that, unless otherwise stated in writing, the intellectual property rights of the following information and content (including but not limited to web pages, text, images, audio, video, charts, data, etc.) belong to Air China:
1. The content and information provided in Air China's related services (including but not limited to software, technology, programs, web pages, text, images, audio, video, graphics, icons, layout design, electronic documents, data materials, etc.);
2. The infrastructure and platforms used by Air China to provide the aforementioned content and information (including but not limited to software, websites, applications, etc.);
3. The various trademarks, commercial images, commercial logos, technical know-how, slogans, copywriting, etc., used in the services provided by Air China;
4. All data and information generated during the development, operation, and maintenance of Air China platform services.
The intellectual property rights of the aforementioned rights and any content included in the services provided by Air China are protected by law and will not be transferred due to any use by you. Without prior written permission from Air China, you agree not to, and not to allow or assist anyone to, use, rent, lend, distribute, display, copy, modify, link, reproduce, compile, publish, scrape, monitor, quote, or create derivative works of the aforementioned content in any form (including but not limited to through any robots, spiders, screen capture programs, or devices), unless you are the rights holder of the work and have obtained legal authorization from the relevant rights holder or have a separate agreement with Air China.
VI. Termination of the Agreement
This agreement shall terminate under any of the following circumstances:
(1) Air China reserves the right to reclaim and deactivate the user account in accordance with this agreement, in which case this agreement shall terminate on the date the account is reclaimed or deactivated;
(2) When the conditions for account deactivation published on the Air China platforms are met, you may deactivate the user account through the website's self-service or Air China's customer service, and this agreement shall terminate on the date the account is deactivated. You understand and agree that you have carefully read the Notice of Account Cancellation of Air China and have understood and agreed to the relevant user cancellation process and the rights and obligations arrangements after cancellation;
(3) Air China reserves the right to terminate all services on the Air China platforms based on its own commercial arrangements with reasonable prior notice. This agreement will terminate on the date when all services on the Air China platforms are terminated in accordance with statutory procedures and methods.
Upon termination of this agreement, Air China will no longer be able to provide you with any services or fulfill any other obligations, including but not limited to retaining or disclosing any information in your original Air China account, and forwarding any unread or unsent information, etc. to you or any third party.
The termination of this agreement does not affect the validity of the intellectual property clauses in Article V and other clauses that should continue to be effective according to their content, nor does it affect the relevant rights and obligations of the parties prior to the termination of this agreement, including but not limited to the non-breaching party pursuing corresponding breach responsibilities from the breaching party in accordance with this agreement.
VII. Legal Responsibility
Legal Responsibility
1. The terms of this agreement are applicable to the laws and regulations of the People's Republic of China. If the terms of the agreement conflict with the laws of the People's Republic of China, the service terms will be reinterpreted in accordance with the provisions of the law, but this does not affect the legal effect and impact of other terms.
2. The formation, execution, interpretation, and resolution of disputes under this agreement shall be governed by the Laws of the People's Republic of China.
3. The user and this Website agree as follows:
(1) Both parties should maintain an attitude of equality, and friendliness, and strive for a reasonable resolution of issues;
(2) In the event of a dispute, it should first be resolved through negotiation.
VIII. Force Majeure or Other Exemption Causes
[Force Majeure] You understand and agree that during the use of this service, you may encounter the following force majeure and other risk factors, causing the interruption or termination of services under this agreement, for which Air China bears no responsibility. Force majeure refers to objective events that are unforeseeable, unavoidable, and insurmountable, and which have a significant impact on one or both parties, due to reasons and acts including but not limited to:
(1) Strike, labor dispute, riot, uprising, disturbance, insufficient productivity or means of production, etc.;
(2) Fire, storm, explosion, war, earthquake, flood, lightning, terrorist attack, etc.;
(3) Government actions, changes in laws and regulations, orders from judicial and administrative authorities, etc.;
In the event of the above situations, Air China will strive to cooperate with relevant departments to promptly carry out repairs, but Air China is exempt from liability for any losses caused to you within the scope permitted by law.
[Other Exemption Causes] You understand and agree that, within the scope permitted by law, Air China is not responsible for service interruptions or terminations caused by the following reasons:
(1) Damage caused by computer viruses, Trojan horses, hacker attacks, or other malicious program attacks;
(2) Network congestion, system instability, equipment downtime maintenance or upgrades, system or equipment failures, communication failures, power failures, third-party service defects, or other reasons caused by the user or Air China that result in service unavailability or service delays;
(3) Improper user operations or the use of platform services through methods not authorized or recognized by Air China;
(4) Other situations that are beyond Air China's control or reasonable foresight.
9. Other
The establishment, validity, interpretation, performance, termination, or any other matters related to this service agreement are governed by the laws and regulations of the People's Republic of China (for the purposes of this clause, excluding the laws and regulations of the Hong Kong Special Administrative Region of China, the Macao Special Administrative Region of China, and China's Taiwan region). If any provision of this agreement is found to be invalid due to conflict with applicable laws and regulations, the remaining provisions of this agreement shall remain in effect.
